Welcome to Side Hustle Photography. By accessing or using my website and photography services ("Services"), you agree to comply with and be bound by the following terms and conditions. Please read them carefully.

1. Acceptance of Terms By accessing my website and/or booking any of my photography services, you agree to these Terms of Service. If you do not agree with any part of these terms, you may not use my Services.

2. Services I offer photography services including, but not limited to, sporting event photography, portrait/group photography, and commercial shoots. Specific service details, including pricing and availability, will be discussed and agreed upon during the booking process.

3. Booking and Payments

• Deposits: A non-refundable deposit of 50% is required at the time of booking to secure your session date. The deposit will be applied toward your final payment.
• Full Payment: Full payment is due no later than 1 day before the session date.
• Late Payments: Late payments may result in cancellation of your session, at my discretion.
• Cancellations: Cancellations must be made at least 2 days before your session date. Deposits are non-refundable, but may be applied to future bookings within the next year.

4. Rescheduling You may request to reschedule your session with at least 2 days (48 hours) notice, subject to availability. I reserve the right to reschedule due to weather conditions or unforeseen circumstances beyond my control.

5. Delivery of Products

• Turnaround Time: I strive to deliver edited images within 30 days after the photography session.
• Digital Files: Edited digital files will be provided in high resolution. Raw/unedited files will not be provided unless specifically agreed upon.

6. Copyright and Usage

• Ownership: I retain the copyright to all images captured during your session. You will receive a personal license for the use of the final images.
• Client Usage: You may use the images for personal, non-commercial purposes such as printing, sharing online (with credit to the photographer), and personal keepsakes.
• Commercial Use: Commercial use of images requires prior written approval and may be subject to additional fees.
• Photographer’s Use: I reserve the right to use any images from your session for promotional purposes, including my website, social media, and marketing materials, unless otherwise agreed upon in writing.

7. Client Responsibilities

• Punctuality: Clients are responsible for arriving on time to their scheduled session. Late arrivals may result in a shortened session or rescheduling, at my discretion.
• Permissions: The client is responsible for obtaining any necessary permissions for locations or third-party appearances during the shoot.

8. Liability I am not liable for any damages, loss, or injury incurred during the session, including but not limited to accidents or equipment failure. In the unlikely event of a total photographic failure, my liability will be limited to the refund of any payments received for the Services.

9. Image Retention I am not obligated to retain any photographs beyond 1 year after delivery. It is your responsibility to back up and safeguard all delivered images.

10. Force Majeure I am not liable for any delays or inability to fulfill my obligations due to events beyond my control, including but not limited to natural disasters, health emergencies, or governmental restrictions.

11. Modifications to Terms I reserve the right to modify these Terms of Service at any time. Any changes will be posted on this page, and your continued use of my Services constitutes acceptance of any revised terms.

12. Governing Law These Terms of Service are governed by the laws of Wisconsin, United States of America. Any disputes arising from these terms will be subject to the exclusive jurisdiction of the courts in Rock County.
